Redesigning Project Delivery: 

The Integrated Agreement for Lean Project Delivery

Speakers:

Tom Owens is General Counsel for NBBJ.  Tom has 25 years in the construction industry, and helps design teams throughout NBBJ in meeting clients’ needs by helping to identify client concerns and finding acceptable solutions.

Scott Sleight recently represented Skanska and is experienced in construction and retail management.  He participated in the development and negotiation of “lean” contracting methods, including three party integrated agreements.

Abstract:

Design and construction is risky business.  Many projects end in disputes, claims and litigation.   Significant resources are wasted protecting against claims, rather than adding value to the facilities.  Lean Project Delivery offers a different path forward. Will Lichtig has been at the center of the Lean Project Delivery movement and has developed the Integrated Agreement for Lean Project Delivery.  This Integrated Agreement is signed by the owner, the designer, and the constructor, and later joined by jointly selected engineering consultants and trade contractors.  The Agreement seeks to realign the commercial interests of the parties and achieve a transparent balance of risk and reward.  It describes the relationships that are established among each of the members of the Integrated Project Delivery Team, recognizing that different members of the team, whether traditionally a consultant or a subcontractor, may have design responsibility. Additionally, the Agreement recognizes that while each IPD Team Member brings different expertise and perspective to the project, the full weight of the entire teams' expertise will need to be integrated throughout the pre-construction process if the value proposition is to be attained.  Joining Will in this presentation will be local attorneys Scott Sleight and Tom Owens.  Scott recently represented Skanska and Tom represented NBBJ in negotiating an Integrated Agreement for a $300m project in Northern California.  Tom, as general counsel to NBBJ, also has crafted NBBJ's own version of the Integrated Agreement.

Lean Construction Institute Cascadia Chapter



The Lean Construction Institute (LCI), a non-profit research organization, was founded in August 1997. LCI's purpose is to develop and disseminate new knowledge regarding the management of work in design, engineering and construction for capital facilities. To that end, the Cascadia chapter is a localized chapter serving the BC, WA, OR region.  LCI has developed the Lean Project Delivery System© (LPDS), and the Last Planner® System of production control. Lean Construction is a production management-based approach to project delivery - a new way to design and build capital facilities. Lean production management has caused a revolution in manufacturing design, supply and assembly. Applied to construction, Lean changes the way work is done throughout the delivery process. Lean Construction extends from the objectives of a lean production system - maximize value and minimize waste - to specific techniques and applies them in a new project delivery process extending from project definition through design, supply and assembly.
